CONSUMER TERMS OF SALE

 

1          Formation of the contract

 

1.1       These terms of sale apply to all goods supplied by Method Statement template. info and main website Method-statement-template.com

 

1.2       No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and sends you confirmation in writing or by email to the address or email address you have given. Once the Supplier does so, there is a binding legal contract between us.

 

1.3       The contract is subject to your right of cancellation (see below).

 

1.4       The Supplier may change these terms of sale without notice to you in relation to future sales.

 

2          Description and price of the goods

 

2.1       The description and price of the goods you order will be as shown in the Supplier’s current catalogue, price lists or on its website at the time you place your order. The word "Download" is used within the product description as all products are delivered in digitally.

 

2.2       The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, the Supplier will inform you as soon as possible, and refund or recredit you for any sum that has been paid by you or debited from your credit card for the goods.

 

2.3       Every effort is made to ensure that prices shown in the Supplier’s current catalogue or shown on its website are accurate at the time you place your order. If an error is found, the price list Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, the Supplier will refund or recredit you for any sum that has been paid by you or debited from your credit card for the goods.

 

2.4       In addition to the price, you will be required to pay a delivery charge for the goods, as shown in the section of the Supplier’s catalogue or website about delivery. (this is for tangible goods, we may include printed versions/cd's in the future)

 

2.5      The website owners have placed these documents for sale on the basis that the buyer understands that the website owners take NO responsibility and are not liable for the content of these documents. Buyers are responsible for health and safety and are to carry out risk assessments where required and are responsible for method statements and any other health and safety related document. Our documents are sold as examples and they should be checked to ensure they comply with the site requirements.

 

In Addition the documents are copywrited by the website owners and are strictly for use by the purchaser only, If any documents found to have been distributed we may decide to prosecute under the The Digital Millennium Copyright Act and the European Union Copyright Directive.

 

3          Payment

 

Payment for the goods and delivery charges can be made by any method shown in the Supplier’s current catalogue, pricelists or shown on its website at the time you place your order. Currently Payments are accepted by Credit or Debit card using Paypal as our card processor, as such buyers and sellers are not covered for buyer and seller protection due to this website selling only Intangible goods.

 

4          Delivery

 

4.1        All goods purchased will be stored in the customers secure account area. ( Customers will receive a link via email to log into customers account and this is clearly stated on relevant pages of our website)

 

4.2       If delivery under 4.1 cannot be made, such as customer did not note user and passwords by request we can deliver to your email address.

 

5          Your right of cancellation

5.1a     The delivery of these documents is electronic and are deemed intangible or non tangible.

 

5.1       You have the right to cancel the contract at any time up to the end of seven working days after you receive the goods (Except Item 5.6 see below). A working day is any day other than weekends and bank or other public holidays.

 

5.2.      To exercise your right of cancellation, you must give written notice to the Supplier by hand or post, fax or email, at the address, fax number or email address shown below, giving details of the goods ordered and (where appropriate) their delivery.

 

5.3       If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to the Supplier at your own cost. The goods must be returned to the address shown below. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit.

 

5.4       Once you have notified the Supplier that you are cancelling the contract, the Supplier will refund or recredit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods.

 

5.5       If you do not return the goods as required, the Supplier may charge you a sum not exceeding the direct costs of recovering the goods.

5.6     You do not have the right to cancel the contract if the order is for digital goods, all items on this website are considered "Intangible"  which  their nature cannot be returned, The website administration panel can determine if the goods have been downloaded or not.

5.7      Refund Policy

           Due to the digital nature of these goods, and in addition that they are sold as such, we do not issue refunds if the items have been delivered by email or downloaded by the customer, we have no proof that the documents will not be used. Any requests for refunds will be the discretion of the site owner.

 

6          Warranty

 

 

6.1       This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Supplier, failure to follow the Supplier’s instructions, or any alteration or repair carried out without the Supplier’s approval.

 

6.2       If the goods supplied to you develop a defect while under warranty, or you have any other complaint about the goods, you should notify the Supplier in writing at the address, fax number or email address shown below.

 

7          Data protection

 

7.1       The Supplier will take all reasonable precautions to keep the details of your order and payment secure, but unless the Supplier is negligent, the Supplier will not be liable for unauthorised access to information supplied by you.

 

8          Applicable law

 

These terms of sale and the supply of the goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.

Additional Information

If you enter a paypal dispute for non receipt etc, please note that the status of your purchase is automatically put on hold as the payment to us is held until the dispute is resolved.

Our admin shows if products have been downloaded and should a dispute for non receipt be placed after our products have been downloaded we are able to prove that items have been delivered digitally.
